He didn't leave it out you asshat. The whole POINT is that the amendment doesn't apply to the states. It only applies to the Fed. The POINT is that the amendment as a whole doesn't apply to the states, that the states CAN make a law "prohibiting the free exercise thereof" when it comes to religion.

How nice that you forgot about the 14th amendment. That's the one that extended (most of) the Bill of Rights to apply to the states as well as the federal government, including that pesky "or prohibiting the free exercise thereof" part of the first amendment.
